JP FDS reserves the right to modify the terms contained in this Privacy Policy at any time. If we make important changes, like how we use your personal information, we will let you know. The modified Privacy Policy would be effective from the date of modification that is posted. 1. WHAT INFORMATION DOES JP FDS COLLECT?
In providing the various services that are available on the mobile application, JP FDS may have to collect certain personal information from you. This information would include the following:
Contact information: JP FDS may collect your name, email, mobile/phone number, postal address, and location details etc.
Payment Data: We may collect data necessary to process your payment if you make purchases, such as your payment instrument number, and the security code associated with your payment instrument. Geolocation Information. JP FDS may request access or permission to track your location from your mobile device, either continuously or while you are using our mobile application, to efficiently facilitate fuel deliveries and track your orders, ensuring a seamless user experience.
Most mobile devices allow you to control or disable the use of location services for applications in the device’s settings menu.JP FDS may also collect this information even when you are not using the application if this collection is enabled through your settings or device permissions. The location data JP FDS collects is used solely to enable and improve the functionality of the App's core features. JP FDS recognizes that the collection of personal data such as the location of users of its app is sensitive and same would never be sold nor shared with third party agents.
2. HOW DOES JP FDS COLLECT YOUR INFORMATION?
JP FDS is strongly committed to keeping your information safe. And to do this we collect your data with your safety in mind.
We collect your information when you:
(a) Interact with us or actively provide your information by registering on the application.
(b) While placing an order for the procurement of fuel.
When you use our App, we may collect and process information about your device's location. This includes both real-time location information and background location data, which is collected even when the App is not in use.
3. HOW DOES JP FDS USE YOUR PERSONAL DATA?
JP FDS uses your personal information to make the application better for you and everyone. This includes:
a. To contact you: The contact information you provide would be used by JP FDS to contact you for the confirmation of an order or for any other Service.
b. To improve the quality of the Services: JP FDS might use your information to improve the functionality of the Services we provide.
c. For marketing purposes: JP FDS might send you information about special promotions or offers. JP FDS might also notify you of new or improved features on the mobile application.
d. Transactional communications: JP FDS may also contact you by way of emails to confirm an order, confirm the payment of Charges etc.
JP FDS shall use your information only in a manner that is permitted by the applicable law.
4. DOES JP FDS SHARE MY INFORMATION WITH THIRD PARTIES?
JP FDS may share your information with third parties. This may include:
a. Service Providers: JP FDS shall share your payment instrument number and the security code associated with payments on the application with Junipay. All payment data is stored by JuniPay. You may find their privacy notice link(s) here: https://www.junipayments.com/policy.html.
b. Compliance with law: JP FDS might share your information to respond to a court order or subpoena.JP FDS may share your information if a government agency or investigatory body requests JP FDS to do so.
c. Mergers and Acquisitions: If JP FDS sells its business or a portion of the same to a new entity, your personal information that is available on the application may be transferred to the new entity.
JP FDS does not extend usage of personal and sensitive user data for serving adverts. We also do not exchange or transfer your personal and sensitive data to a third party for monetary consideration.
5. HOW SECURED IS MY PERSONAL DATA?
Please note that neither JP FDS nor any of its employees would have access to the password that relates to your User account on the mobile application. You shall be solely responsible for protecting your login credentials to the application, and JP FDS shall not be liable in any manner for unauthorized use of your login credentials. You shall be liable to JP FDS for any loss suffered by JP FDS because of an unauthorized use of your login credentials. In the event of any misuse or suspected misuse of the same, please notify JP FDS at www.jpghana.com .
While JP FDS shall seek to implement the best market practices and security policies for the protection of your personal information, it shall not be liable for theft or loss of data due to unauthorized access to the User’s electronic devices.
6. DUTIES OF JP FDS UNDER THE APPLICABLE LAW
JP FDS acknowledges and firmly commits to adhering to the principles and regulations outlined in the Data Protection Act, 2012 (ACT 843). We recognize the significance of safeguarding the privacy and security of our customers' sensitive data, both during the account creation process and while utilizing our app.

7. WHAT ARE MY RIGHTS?
JP FDS hereby acknowledges that the collection and usage of sensitive data from customers upon the creation of an account and that also obtain while using the App complies with the Data protection Act ,2012 [ACT 843]
Under certain circumstances, you have rights under the data protection law in relation to the information JP FDS holds about you.
These include:
a. The right of access: this is also known as a “data subject access request”. You have the right to receive a copy of the information we hold about you and to check that we are lawfully processing it.
b. The right to rectification: you are entitled to have any incomplete or inaccurate information we hold about you corrected, though in some cases, we need to verify the accuracy of the new information you provide to us.
c. The right to erasure: this is also known as “the right to be forgotten” which enables you to request the deletion or removal of certain of the information that we hold about you where there is no good reason for us continuing to process it. This right is not absolute.
d. The right to withdraw consent: Where we rely on consent to use your information, you have the right to withdraw that consent at any time. Withdrawing consent will not, however, make unlawful our use of your information before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain services to you.
8. REDRESSAL OF GRIEVANCES
If you have any questions or grievances regarding the Website, the contents thereof or the Services, the User may reach out to customer support at email address www.jpghana.com (the “Grievance Officer”). The Grievance Officer shall address any complaint or grievance that is raised.
9. MISCELLANEOUS PROVISIONS
Force Majeure: JP FDS shall not be responsible for any cessation, interruption, or delay in the performance of its obligations hereunder due to earthquake, flood, fire, storm, natural disaster, act of God, war, terrorism, armed conflict, labor strike, lockout, or boycott. JP FDS may at any time, in its sole discretion and without advance notice to you, cease operation of the mobile application.
No Waiver: A delay or failure by JP FDS to exercise or enforce any right or provision of this Privacy Policy will not constitute a waiver of such right or provision.
Notices: All notices given to a User by JP FDS or by a User to JP FDS or another User shall be in writing and in the English language. Such notice shall be sent by e-mail or mailed by a prepaid internationally recognized courier service to the intended recipient at the address set out below, or any changed address that is notified by either Party:
